GENERAL CONDITIONS OF SALE
Article 1: General Provisions
In the event of any dispute, the French version of these Conditions takes precedence over the English translation.
These General Conditions of Sale apply to individual reservations made directly with the hotel and to reservations made online through our website or by telephone or email. For group reservations there may be other conditions stipulated, but if not then these general conditions of sale apply.
The client undertakes to comply with and enforce all the conditions specified in this document as well as legal and regulatory obligations.
These general conditions may be subject to change without notice and the applicable conditions will be those in force at the date of commencement of the stay at the hotel.
Article 2: Capacity
The client confirms their full capacity to enter into a legal contract, ie is legally of adult age, has the mental capacity to contract and is not under a guardianship arrangement, etc.
Article 3: Booking terms – Deposit
Tarifs are quoted in Euros (€ or EUR) per room and per night for the confirmed number of clients, taxes and service included but excluding “taxe de séjour” (tourism tax).
Tarifs quoted include solely the services confirmed in the reservation.
Rates quoted on the website may be subject to change without notice and only the price detailed in the booking confirmation forms the contract.
A reservation is established only if the client provides a payment card number complete with validity date, current at the date of the stay, together with the card security number. The hotel reserves the right to reject any booking in the event of the payment card number being incorrect or invalid or the reservation is incomplete.
Upon registration of the reservation an appropriate card payment will be processed. An amount equal to 35% of the total price of the stay for stays of 3 nights or more, 50% of the total price of the stay for a stay of fewer than 3 nights, and 100% of the price of a stay of one night, will be charged. Such payments will only be refundable according to the conditions stated in Article 6: Cancellation policy.
Upon arrival, clients are required to present their identity document and a payment card valid for the duration of their stay in the hotel.
Article 4: Methods of payment
The hotel reserves the right to require full payment for the stay at the time of check-in.
In accordance with the French legal Civil Code art 2322 al 5, the hotel has the right to retain the client’s luggage and personal effects in the event of the client’s failure to pay. This right covers all items that the client has in the hotel – luggage, vehicles, valuables, etc.
At the end of the stay, any deposit will be deducted from the final invoice covering the period initially booked. Sales invoices are payable at Reception before the client’s departure. Except in the case of any prior agreement, extension of payment time beyond check-out is not offered. Charges for extras such as laundry, drinks, telephone calls, “taxe de sejour” (tourism tax) provided to clients must be settled before departure. If payment has not been made, an invoice will be sent to the client and the client undertakes to make immediate payment upon receipt.
For accommodation and extras, the Hotel Panoramic accepts payment cards (Visa, Mastercard and American Express), cash excluding €100, €200 and €500 notes, and “cheques vacances ANCV”. Personal cheques or postal orders are not accepted in payment.
For payment of deposits, the hotel accepts payment cards (Visa, Mastercard and American Express), “cheques vacances ANCV” and bank transfers. In the case of a transfer from a foreign bank, transaction costs are to be borne in full by the client.

Article 5: Availability of rooms
On the day of arrival, rooms are available from 15.00 and the client must check-in at Reception before 19.00 at the latest. On the day of departure, rooms must be vacated by 11.00. In the case of late check-out, one night’s additional accommodation will be charged.
Article 6: Cancellation conditions for reservations made direct with the hotel
Any request for change or cancellation must be made by email to email@example.com or by telephone to (+31) 05.61.79.30.90.
Cancellation is not effected until it is confirmed by the Hotel Panoramic in writing.
In the case of change to or cancellation of a reservation, the following conditions will apply (except in the case of force majeure):
Low season – the client may cancel without incurring cancellation fees up until two days before arrival.
High season = French Christmas holiday period, Luchon Film Festival, French winter holidays (zone A, B and C) and from 1 July until 15 September – the client may cancel without incurring cancellation fees up until 15 days before arrival.
Payments for reservations on promotional rates are not refundable in the case of cancellation or modification (see Art. 14).
For reservations made through our partners’ websites, cancellation must be made via the site on which the booking was made. The cancellation conditions for such bookings may be different from those which apply to reservations made directly with the Hotel Panoramic.
No-show: If the client does not arrive at the hotel by the time detailed earlier in these conditions, without having previously notified the hotel of their late arrival, this constitutes a cancellation or no-show. No shows – bookings made and not cancelled – will be invoiced at the rate for the total stay booked.
Curtailment of the stay : The hotel may retain any deposit paid and claim payment from the client up to the value of the total loss suffered, including damages and interest.
Article 7: Force Majeure
Force majeure is deemed to mean any event outside the parties’ control which is unpredictable and insurmountable and which prevents fulfilment in all or in part of the obligations of the contract. This applies to strikes by transport staff, hotel staff, riots, acts of terrorism, total or partial destruction of the establishment, breakdowns which cannot be repaired within a reasonable time, etc.
Article 8: The Hotel and general practicalities
Breakfast is not included in the room rate. Child rate for breakfast applies to children up to and including the age of 12 years.
For room-service breakfast, the rate is the same for adults and for children.
The hotel reserves the right to invoice the client for all breakfasts ordered even if not consumed. The client may cancel a breakfast order up to 20.30 hrs the evening before the breakfast is to be served.
For hygiene and safety reasons, animals are not admitted to the hotel premises.
The hotel is entirely non-smoking. Guests are not permitted to take sports equipment into the bedrooms.
Parking: The client is responsible for items left in their car. The hotel bears no responsibility in the case of theft or vandalism.
The client undertakes to use the room in an appropriate, respectful and sober manner. Any behaviour prejudicial to good order, atmosphere and standing in the hotel may result in the management requiring the client to leave the establishment without any refund or allowance should any payment already have been made by the client.
Article 9: Relocation
In the event of unavailability of accommodation in the Hotel Panoramic or in the case of force majeure, the Hotel Panoramic reserves the right the relocate the client for all or part of their booking into a hotel of equivalent or superior category, offering similar services. If the guest cannot be fully or partially accommodated in such a hotel, the hotelier will look for another solution in a lower category hotel, apartment, hotel residence, bed and breakfast, etc, in order to achieve a solution to accommodating the client. Such transfer will be made at the expense of the hotelier, and the client does not have the right to seek any additional compensation.
Article 10: Complaints
Any complaint must be sent to the Hotel Panoramic by recorded delivery within 15 days of the end of the relevant stay at the hotel. After this time, no claim can be made.
The Hotel Panoramic undertakes to respond within one month. If the matter remains unresolved, the client may refer it to the Ombudsman for Tourism & Travel – contact details are at www.mtv.travel.
Article 11: Data Protection
In accordance with French Law 78-17, known as Data Processing and Freedoms, customers are advised that their reservation is recorded in a computer database. Its administrators have the right of access to and correction of the data held at the head office: SARL Dovan – Hotel Panoramic 6 avenue Carnot 31110 Bagneres de Luchon. This data remains confidential and is not released to third parties.
Hotel Panoramic offers wireless internet access. The Client agrees that computer resources provided will not be used in any way for reproduction, representation, making available or communicating to the public any works or objects protected by a Copyright, associated rights, such as texts, photographs, audio-visual material, software and video games, without the authorisation of the owners of the rights as specified in Books I and II of the Intellectual Property Code

Article 12: Responsibilities
The hotel accepts no responsibility in the event of theft, loss or damage to clients’ belongings during their stay.
A room safe is provided.
The guest is responsible for their room key. At Reception a safe box is available where room keys may be left during the day. Guests returning to the Hotel after 20.00 are requested to retain their keys during the day. If the key is lost, the cost of replacing the key or lock will be charged to the customer.
When entering the hotel at times when Reception is closed, for everyone’s security the guest must ensure that the hotel door is fully closed. The guest will not disclose to third parties the entry codes for the hotel or car park.
The customer will be liable for any damage or vandalism occurring as a result of their occupation of the premises and/or others of their party and/or staff for which the customer is responsible, whether fixtures and fittings, decoration or property belonging or not belonging to the hotel. In this situation the Hotel Panoramic has the right to ask the client to leave the establishment without compensation and without refund for the stay in progress, and to require reimbursement for the cost of damages caused by such acts.
Article 13: Long Stay
For stays of longer than one week, the Hotel’s weekly invoice must be paid immediately by card, cash or “cheques vacances ANCV”. Deposits are deducted from the final invoice at the end of the stay.
Article 14: Promotional Rates
Promotions are only as detailed on the Hotel Panoramic website. Promotional bookings may not be combined, modified or cancelled and promotions are only valid at the specified rates and dates.
The conditions are explained on the website and are accepted by the client.
The customer’s payment card details are required when booking a promotional rate.
Promotion bookings must be paid in full at the time of booking. No refund is available in the case of cancellation.
Article 15: Reservation
The 14-day withdrawal period pursuant to article L221-28 of the Consumer Code is not applicable and may not be invoked.
Article 16: Applicable Law
These Terms and Conditions of Sale are governed by French Law, both in detail and in custom. Disputes will be exclusively pursued within the jurisdiction of the French courts. In the case of any discrepancy between the English and French versions of these Terms and Conditions of Sale, the French version takes precedence.
